1. Who these terms are between
These Terms are an agreement between you and ФОП Гавришкевич Віктор Вікторович, an individual entrepreneur (фізична особа-підприємець) registered in Ukraine ("Petlify", "we", "us").
By creating an account or using the Petlify website or mobile app (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract.
2. What Petlify is — and is not
Petlify is an online marketplace where pet owners ("Owners") find and contact independent pet sitters ("Sitters"). We provide search, profiles, booking records, messaging and scheduling tools.
We are not a party to any agreement between an Owner and a Sitter. Sitters are independent third-party service providers. They are not our employees, agents, partners or franchisees. We do not direct, supervise or control how care is performed, and we do not guarantee the quality, safety, legality or outcome of any service.
We do not provide pet-care services, veterinary services, boarding facilities, training, transport or insurance.
3. Pet-care payments happen between you and the other person
Owners and Sitters agree the price, method and timing of payment for pet-care services directly with each other.
Any price displayed in a booking is an informational estimate calculated from the rates the Sitter entered. It is not an invoice, a quote we stand behind, or an amount we collect.
Petlify does not accept, hold, escrow or transmit pet-care payments, does not take a commission from their value, and does not provide payment protection, guarantees, refunds or chargeback support for them. If a payment dispute arises between an Owner and a Sitter, the parties resolve it between themselves.
4. Accounts
You are responsible for the accuracy of the information you provide and for everything that happens under your account. Keep your credentials secure and tell us promptly at support@petlify.pet if you suspect unauthorised access.
We may suspend or terminate an account that violates these Terms, creates risk for other users or animals, or is used to circumvent the Service.
5. Verification is a check, not a warranty
Where a profile displays a verification status, it means the specific check described on that profile was completed. It is not a guarantee of a person's identity, character, competence, honesty, criminal history, or suitability to care for your animal.
You remain responsible for your own judgement: meet the person, ask questions, check references, and do not leave an animal with someone you are not comfortable with.
6. Sitter subscriptions
Sitters may use the free Standard plan or purchase a paid plan. Current prices and plan features are shown before purchase.
A subscription buys platform features — visibility, limits, tools. It does not buy bookings, income, ranking guarantees, or any change to how Owners and Sitters pay each other.
A paid plan is bought by a Sitter for their own commercial activity — to receive enquiries and earn from pet care. It is not a personal or household purchase.
6.1 Automatic renewal
Paid plans renew automatically. Unless you cancel, your plan renews at the end of each billing period and the then-current price is charged to your payment method, indefinitely, until you cancel.
The billing period, the amount, and the renewal date are shown before you purchase and in Settings → Billing at any time.
6.2 Cancelling
You can cancel at any time from Settings → Billing, in the same number of steps it took to subscribe. No phone call, no email, no retention conversation.
Cancellation takes effect at the end of the period you have already paid for. You keep paid features until that date, and you are not charged again.
6.3 Who charges you
Paid subscriptions are sold and processed by Paddle, which acts as the merchant of record and the seller for that transaction. Your payment method is charged by them, they issue the receipt, and applicable sales tax is handled by them. Their terms apply to the payment transaction; these Terms govern your use of the Service.
6.4 Refunds and withdrawal rights
Subscription transactions, cancellations, statutory withdrawal rights and refunds are administered by Paddle under its Buyer Terms and Refund Policy. Petlify does not issue subscription refunds directly.
Nothing in these Terms limits any mandatory right you have under the law of your country of residence, including any statutory right to withdraw from a purchase within a set period.
6.5 Changing plans
Switching between paid plans takes effect immediately. On an upgrade we charge only the difference for the days remaining in the current period, crediting the unused part of the plan you are leaving. On a downgrade nothing is charged that day and the unused part is credited against your following invoices.
6.6 Price changes
We may change subscription prices. A change applies from your next renewal, and we will tell you before it takes effect, with enough notice for you to cancel first.
7. Your content
You keep ownership of the text, photos and other material you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt and display it for the purpose of operating and promoting the Service.
You are responsible for having the rights to what you post.
We may remove content that violates these Terms or the law. A removed review stops affecting profiles and ratings, and the record is retained for our own audit purposes.
8. Acceptable use
Do not: break the law; harm or neglect an animal; misrepresent who you are; post false, defamatory, harassing or discriminatory content; collect other users' data; scrape, reverse-engineer or overload the Service; or use it to advertise a competing marketplace.
Arranging payment for pet care directly between an Owner and a Sitter is how this Service works, and is not a breach of these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted or error-free, that profile information is accurate, or that any Owner or Sitter is suitable for you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PETLIFY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR FOR INJURY TO OR DEATH OF AN ANIMAL, ARISING FROM OR RELATED TO THE SERVICE OR ANY INTERACTION BETWEEN USERS.
OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE FEES PAID FOR YOUR PETLIFY SUBSCRIPTION IN THAT PERIOD OR (B) US$100.
These limits do not apply to liability that cannot be limited or excluded under applicable law — including liability for death or personal injury caused by negligence, for fraud, and any mandatory consumer rights of your country of residence.
11. Indemnification
You will indemnify and hold harmless Petlify and its officers and staff from claims, damages and reasonable legal fees arising from your use of the Service, your content, your breach of these Terms, or your interactions with other users.
12. Governing law and disputes
These Terms are governed by the law of Ukraine, without regard to conflict-of-laws rules.
If you are a consumer, you keep every mandatory protection and every right of access to the courts given to you by the law of your country of habitual residence. Nothing in this section removes those.
We would rather resolve a problem than argue about it: write to support@petlify.pet first, and we will try to settle it directly.
13. Changes
We may update these Terms. Material changes will be notified in the app or by email before they take effect. Continued use after that date means you accept the updated Terms.
14. Termination
You may stop using the Service and delete your account at any time. Sections that by their nature should survive — content licence for already-published material, disclaimers, limitation of liability, indemnity, governing law — survive termination.
